What Constitutes Rape In New Jersey And What Are The Penalties ?

The term rape refers to nonconsensual sexual penetration of an adult or child. When the conduct involves a child under 13 years old, the child molestation charge is termed aggravated sexual assault falling under the Lundsford Act. The penalties are 25-life in prison and a fine of up to $200,000. Aggravated sexual assault otherwise carries 10-20 years in prison. Sexual assault, which is another form of rape found in the NJ Criminal Code, results in 5-10 years in prison and a maximum fine of $150,000. All rape charges are also subject to Megans Law and Community/Parole Supervision for Life.
