DWI in a School Zone in Edison NJ
There are two main points that you need to know if you have been charged with DWI in a school zone in Edison Township. First, you need to keep in mind that the school zone charge applies on top of the N.J.S.A. 39:4-50 violation you are currently facing. The law treats dwi/dui in a school zone as a separate violation under N.J.S.A. 39:4-50g. The prosecutor in Edison will have to present an official school zone map demonstrating the you operated your vehicle while intoxicated/impaired within 1,000 feet of property owned or leased by a school or school board, and regularly used for school purposes. If this and the other necessary proofs in order to establish intoxication exists, the second point you need to know is that you will face very different penalties than a regular DWI. A first offense DWI in a school zone will result in (1) a fine of between $606 and $1006; (2) a jail term of up to 60 days; and (3) suspension of driving privileges for one to two years. It is of note that all of these also carry with them mandatory annual surcharges ranging from $1000 to $1500, depending on the number of prior convictions, for a period of three years.
