Grading
Prostitution is a disorderly persons offense when it involves personally offering sexual activity in exchange for something of economic value. These activities are elevated to a fourth-degree crime if the conviction represents a second or third violation. It is a third-degree crime to commit a fourth or subsequent offense in this capacity. It is a second-degree crime to knowingly engage in prostitution with someone under eighteen.

Penalties
A disorderly persons offense for prostitution results in a fine of up to $1,000 and up to six months in the county jail. Fourth-degree prosecution carries up to 18 months in state prison and fine as high as $10,000. The maximum penalties for third-degree prostitution include a fine of $15,000 and 5 years in prison. Second-degree prosecution triggers a potential fine of $150,000 and 5-10 years in prison. In addition, there is a six months driver’s license suspension that may be imposed if a motor vehicle was used in the commission of prostitution.
