Whenever someone is arrested for driving while intoxicated in New Jersey, the car they were operating is impounded. The reason why this always occurs is because the law contained at N.J.S.A. 39:4-50.23 imposes an obligation on law enforcement to impound the vehicle. This requirement is commonly referred to as “John’s Law.” The purpose of this law is to prevent the accused from operating the vehicle in case he or she remains intoxicated and/or intends on committing another incident of DWI.
