Charged With a First DWI Offense in Edison Township
Unlike repeat offender cases, the New Jersey DWI Law establishes different penalties that apply to a first offense depending on whether the blood alcohol content (“BAC”) of the accused was above .15%. Cases that are resolved with a BAC reading placed into evidence of at least .08% but less than .15% result in “First Tier” penalties. The same is the case for DWI cases that are resolved with no BAC placed into evidence (e.g. where we are successful in suppressing the reading). When the admitted BAC level is .15% or above, the court is obligated to apply “Second Tier” penalties.
First Tier Cases. The court must impose of a fine of $300-$500, an IDRC fee of $230, a DWI surcharge of $100, $33 in court costs, a $100 Alcohol Education & Rehabilitation Fund assessment, and an annual DWI surcharge of $1,000 for three (3) years. The court must also impose at least 12 hours in the IDRC and a mandatory driver’s license suspension until such time as the defendant installs an ignition interlock on his/her vehicle(s). Up to 30 days in jail may also be imposed.
Second Tier Cases. The second-tier penalties are essentially the same in terms of fines and monetary assessments. The difference lies in the period of suspension, which is enhanced to 4-6 months. An ignition interlock must also be in place for the period of suspension plus 9-15 following the restoration of driving privileges.
In addition to all of the penalties, there are ancillary consequences that flow from a first offense conviction.
