Counterfeiting involves knowingly creating, selling or possessing an imitation writing or other item. This concept can arise not only under 2C:21-1 (“Forgery & Related Offenses) but also under N.J.S.A. 2C:21-32, the New Jersey Trademark Counterfeiting Act. Counterfeiting doesn’t touch on identification, money or similar items when this is the case but rather trademark infringement such as where, for example, fake designer items are involved (e.g. Chanel, Gucci, Louis Vuitton, etc.).
