Washington Township Domestic Violence
A potentially complicated situation is created when someone is charged with domestic violence in Washington Township or another municipality. The primary reason for this statement stems from the fact that this type of case typically results in both restraining order proceedings in the Family Division of the Gloucester County Superior Court and a parallel criminal proceeding in either Washington Township Municipal Court (e.g. simple assault, harassment or other disorderly persons offense) or the Superior Court (e.g. aggravated assault, terroristic threat, stalking or other indictable crime).
When the Washington Township Police Department are summonsed to the scene of a domestic call they typically encounter allegations of assault or other allegations of violence. If they find probable cause to believe domestic violence has occurred, they ask the victim if he/she would like to obtain a temporary restraining order. They also sign a criminal charge against the aggressor. The restraining order results in a bar of contact between the victim and the defendant, and also a hearing at the Gloucester County Superior Court to determine whether the restraints should become permanent and final. This proceeding is referred to as a final restraining order hearing.
