Possession of Cocaine
Personal possession of cocaine is the least serious charge someone can face with this form of CDS. Under N.J.S.A. 2C:35-10, an individual cannot possess cocaine without committing a third degree crime. A third degree conviction for possession of cocaine can result in 5 years in prison and a fine of $35,000. There is also at least 100 hours of community service that must be performed if the possession is within 1,000 feet of property owned or leased by a school (a.k.a. school zone).
Cocaine Distribution
Selling, distributing or possession with intent to distribute cocaine is prosecuted in accordance with N.J.S.A. 2C:35-5. The grading and penalties for distribution of cocaine are very similar to those that apply to heroin. When the cocaine distribution charge involves 5 ounces or more, a conviction results in first degree crime punishable by up to 20 years in prison and a fine up to $500,000. Distribution of one half ounce but less than 5 ounces is a second degree crime. Second degree cocaine distribution results in a maximum fine of $150,000 and the possibility of 10 years in prison. Selling or distributing less than a half ounce of cocaine is a third degree crime that carries the possibility of 5 years in prison and a $75,000 fine. All distribution charges also carry a 6 month driver’s license suspension, as well as enhanced penalties where the cocaine is being sold in a school zone or public park zone.
