Penalties If Convicted Of DWI in Freehold New Jersey

Almost immediately after someone is stopped and charged with DWI/DUI, their first two questions are what are the penalties I am facing and how to avoid a conviction. Individuals also want to know what their chances are of beating the drunk driving charge. In terms of penalties, your exposure to a license suspension, fines, jail and other penalties hinge on whether this is a first offense, second offense or you are facing a third of subsequent DUI charge. The headings below discuss the specific penalties that apply in each of these settings:

First Offense. If this is your first offense and your blood alcohol concentration (“BAC”) is between .08% and .099%, you will face a fine of $250-$400, incarceration at the Monmouth County Jail for up to 30 days, and a suspension of your license until you install an ignition interlock on your car, which must remain in place for at least 3 months.

If you are convicted for a first offense DWI in Freehold and have a BAC of at least .10% but less than .15%, the fine is $300-$500, the potential jail time is 30 days, and you must forfeit your driver’s license until the ignition interlock is installed and remains for 7 months to 1 year.

A Freehold first offense DWI with a BAC of .15% or more (or a first offense for driving under the influence of marijuana, prescription medication or other drugs) carries a mandatory license suspension of 4-6 months, an ignition interlock obligation of 9-15 months following restoration of your license, and you can be sentenced to up to 30 days in jail.

You will also pay a $1,000 per year surcharge for 3 consecutive years as a condition of restoration of your driver’s license, thousands of dollars in increased car insurance premiums, and have to complete 12-48 hours in the Intoxicated Driver Resource Center (“IDRC”). The truth is that you will face in excess of $10,000 in cumulative expenses (e.g. fines, court assessments, ignition interlock fees, surcharges and increased insurance rates) if you are convicted for a first offense.


Second Offense. The penalties that you face at a sentencing for a second offense for DWI or DUI in Freehold include a license suspension of 1-2 years, a fine of $500-$1,000, incarceration for 48 to 90 days, 30 days of community service, installation of an ignition interlock for the period of suspension and 2-4 years following restoration of your license,  48 hours in the IDRC, and a surcharge of $1,000 a year for 3 years.


Third Offense (or More). Penalties for a third or subsequent DWI offense are stiff with a fine of $1,000, a 180 day jail sentence, 8 year license suspension, 30 days of community service, a surcharge of $1,500 for 3 years, and installation of an ignition interlock for 2-4 years after your license is restored.


Refusing the Breath Test. The penalties for a first, second or third offense for breath test refusal largely mimic those for DWI or DUI except that there is no jail term for a third or subsequent offense for refusal under N.J.S.A. 39:4-50.4.

The area was first settled in 1685 by a group of Scottish reformers fleeing religious persecution.
