Resisting or Fleeing an Officer in Point Pleasant Beach
Ordinance Violations and Violations of N.J.S.A. 2C:29-2 or 2C:29-3
Point Pleasant Beach has adopted an ordinance that specifically addresses resisting arrest and fleeing a police officer. An ordinance is a local law and the ordinance in Point Pleasant Beach involves potential jail exposure of up to 90 days in jail, fines and the possibility of probation. The ordinance provides as follows:
3-19.1 Unlawful Evasion of Police. No person in this borough shall attempt to flee from or evade on foot or any other manner any police officer or any person duly empowered with police authority while in the discharge or apparent discharge of his duty.
In addition to the ordinance, a Point Pleasant Beach Police Officer can issue a resisting arrest, hindering and evading complaint, summons or ticket under New Jersey’s Criminal Code. N.J.S.A. 2C:29-2 is New Jersey’s resisting arrest statute and N.J.S.A. 2C:29-3 is New Jersey’s hindering statute. A conviction under either of these statutes involves potential jail of six (6) months, fines, and the possibility of probation. A conviction shall also result in a NJ criminal record.

Point Pleasant Beach has also adopted an Ordinance which is intended to address obstruction and interference with the administration of justice. The related ordinance provides as follows:
3-19.2 Obstruction or Interference with Police. No person in this borough shall resist, obstruct or interfere with any police officer or any person duly empowered with police authority nor shall any person disobey a lawful order or instruction of any such officer.
There is also a commensurate NJ Criminal Code violation which can be charged by a police officer. An arrest or charge in this situation would be based on N.J.S.A. 2C:29-1. A conviction under this provision is a disorderly persons offense and involves monetary fines, possible probation and up to six (6) months in jail.
