There are a variety of ways in which a Judge or the New Jersey Motor Vehicle Commission may suspend your license. Title 39 to suspend or revoke a driver’s license and/or registration in situations where the driver in question demonstrates a physical or mental disqualification.
What Are Common Physical or Mental Driving Disqualifications?
The New Jersey Motor Vehicle Commission most often enters an indefinite suspension for the following impairments:
- Visual impairment
- Confusion
- Disorientation
- Memory loss or lapses
- Impaired or altered consciousness
- Alzheimer’s or dementia
- Neurological conditions, such as seizure or blackout disorders
- Sleep disorders (sleep apnea)
This suspension could have stemmed from a report to the Motor Vehicle Commission by a Physician (as New Jersey law requires physicians to report patients to MVC if they have seizures, periods of unconsciousness or the impairment or loss of motor coordination, such as those associated with various forms of epilepsy), Law Enforcement Officer, or even a family member/friend. How Do I Fight a License Suspension Based on My Physical or Mental Disqualification?
The MVC may grant those with a scheduled suspension an opportunity to request a suspension hearing. Typically, this will be done by the attorney that you retain. Upon requesting a hearing, the MVC will review the request, and determine if the driver has presented facts sufficient to warrant granting a hearing. If the New Jersey MVC will schedule and notify you of a date on which you will be able to present your case. Even if the hearing does not result in a positive outcome, all decisions are subject to appeal to the State of New Jersey Appellate Division.
